Terms Of Service
All services provided by Darsh Web Solutions are subject to the following terms and conditions.
Quotes & Proposals
Price quotes provided to prospects will be honored for 15 days. A new quote will then be provided upon request. Proposals that have been written, but not signed by the client will only be accepted within 15 days of the delivery date. A new proposal may be drawn up upon request.
Charges & Fees
Unless otherwiese neotitated, all projects require an initial 25% deposit. The remaining 75% balance will be due on project's completion and before it is released to the client or published to the internet.
Darsh Web Solutions retains the right to hold all graphics, and project development with the exception of content and graphics provided by the client, until payment is received for such items.
Payments
Darsh Web Solutions accepts payments via PayPal or any other pre-negotiated payment mode. Your project will not be released to you or uploaded until full payment is received.
Web Site Design Credit
Unless otherwise negotiated, all custom website design clients will have a Design by: Darsh Web Solutions link on their website in the footer of all pages. By hiring us to work on your website you are agreeing to this, and that you understand that this link may NOT be removed without our consent.
Copyright & Ownership
Upon project completion and after full and final payment, Darsh Web Solutions transfers all rights and ownership of custom designs and programming written by Darsh Web Solutions to the client. Softwares and applications used for the project design/development, and third party graphics/libraries/programs are not transferred to the client and remain under copyright of their respective owners.
Darsh Web Solutions reserves the right to resell custom designed web sites that remain unpaid by the original client, unaccepted mockups or other graphics created by Darsh Web Solutions but not in legal use by the client.
Unless otherwise negotiated, Darsh Web Solutions reserves the right to display websites and graphics that have been designed by Darsh Web Solutions on their website, and in any marketing material to aid as examples of our work.
Refunds
Subject to a project's proposal, Darsh Web Solutions may require a deposit before we begin work on the project. A request to terminate services must be presented to Darsh Web Solutions in writing.
Refund Amounts will be calculated in the following ways:
- A cancellation fee of 30% (thirty percent) of the total deposit paid will be retained for projects that have been started and are in the design process.
- A design fee of $80 US will be retained on projects where the design portion of the development has been completed, and the client has accepted the design, but whereas the development process of the project has not begun. Upon payment, the design will be released to the client for use.
- Projects that are in the development process at the time the request for termination is received will be billed at the hourly rate of $12 US per hour. Should the amount of time put into your project be greater than the deposit you have paid to Darsh Web Solutions, you will be billed the difference. Upon payment of these fees, the work completed up to the time of termination will be released to the client.
No refunds will be made for projects which have been completed and transferred to client.
No refunds will be offered for third-party services, such as but not limited to hosting, domain registration and SEO, which Darsh Web Solutions may procure for the client.
Non-Communication
If we are unable to communicate with a client on a project for a duration of at least sixty days (60) by email during the design and development process, the project will be canceled without prior notice and no refund will be issued.
During the project design and development phase we will require regular communication and feedback from clients. We will not be liable for any delays, losses or damages caused by delayed responses on client's part.
Development & Delivery
Darsh Web Solutions will develop the project as per the specifications laid out in the project's proposal. If the client is unsure of the scope of the project's specifications, the onus is on the client to confirm and clarify this with Darsh Web Solutions. The client may request a change in project specifications at any time. The project proposal, costing and timeframe will be updated accordingly.
Unless otherwise negotiated, delivery of projects will be through email or through direct upload to client's server. Client's server or hosting platform must conform to the hosting requirements laid out in the project's proposal.
Liability
Services purchased from Darsh Web Solutions are provided "as is" without warranty of any kind that the web design project will be uninterrupted or error free. In no event shall Darsh Web Solutions be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services, and/ore goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the web design is with the client.
Project Consideration
Darsh Web Solutions will not accept projects that we find morally questionable, unethical, or distasteful.
Notice: This Agreement is subject to Punjab Court Jurisdiction.
Acceptance
Please note that by submitting your downpayment for our services you are agreeing to all of our terms of service as written here. Darsh Web Solutions reserves the right to change or update these terms at any time without prior notice.
